During the Thanksgiving holiday and following Black Friday weekend there were numerous DUI roadblocks throughout New Jersey.

Read my blog article on the legality of DUI checkpoints
While it may appear that checkpoints and roadblocks violate the Fourth Amendment, the United States Supreme Court and the New Jersey Supreme Court have found this police tactic permissible provided that the police satisfy certain requirements. The State, however, always bears the burden of establishing the constitutionality of that roadblock.
If you or a friend was arrested at one of these checkpoints, there are legal procedures and protocols that must be followed during a DWI checkpoint (aka a DWI roadblock) and are you automatically guilty of DWI if stopped at a NJ DWI checkpoint.
If these procedures were not followed it may be possible to have your pending DWI charge dismissed. If that is not an option it is imperative to have a drunk driving attorney in your corner to ensure that your rights are protected.
