What makes a DUI checkpoint legal in Pennsylvania? – Gambone Law
While it may appear that checkpoints and roadblocks violate the Fourth Amendment to the United States Constitution and Article 1, Section 8 of the Pennsylvania Constitution, the United States Supreme Court and the Pennsylvania’s Supreme Court have found this police tactic permissible provided that the police satisfy certain requirements. The Commonwealth, however, through the assistant district attorney, bears the burden of establishing the constitutionality of that roadblock.
If you or a friend was arrested at one of these checkpoints, there are legal procedures and protocols that must be followed during a DUI checkpoint (aka a DUI roadblock) and are you automatically guilty of DUI if stopped at a PA DUI checkpoint.
If these procedures were not followed it may be possible to have your pending DUI charge dismissed. If that is not an option it is imperative to have a drunk driving attorney in your corner to ensure that your rights are protected.
