In most situations if a person has an existing bench warrant, they will be arrested during a routine traffic stop or perhaps going through a security check point at an airport, train station, or bus depot.
We frequently receive questions regarding guns and firearms. In addition, we also receive questions regarding what is and isn’t considered a firearm or gun in Pennsylvania and New Jersey.
Here are some common questions and phrases police officers ask to investigate and collect information which could lead to a vehicle search or a search warrant:
New York, like New Jersey, does allow permits to carry handguns, but it was virtually impossible (before June 23, 2022) to obtain one given the process. In New York, similar to New Jersey, the applicant must show a “justified” need for the gun and a Court must approve the application. In most situations, the permit isn’t issued.
The US Supreme Court, in a 6-3 decision, has struck down a New York Law which prevented people in New York from obtaining a permit to carry without demonstrating a particular need for carrying a gun.
There is a difference, however, between searches done by a government official, such as a police officer or other law enforcement and private searches. All persons have a 4th Amendment right against illegal search and seizure and both Pennsylvania and New Jersey’s constitution provide further protections.
