Nj Dui/Dwi And The Resources Available To Those Charged
Our firm’s New Jersey DWI/DUI practice is focused on getting not guilty verdicts for clients. There are situations, however, where a client either pleads guilty or is found guilty at trial.
In these situations the New Jersey Intoxicated Driving Program (IDP) is responsible for the administration of sentences following a person’s conviction for alcohol or drug related driving offenses. This program schedules all meetings and follow up requirements for person’s convicted of DUI/DWI in New Jersey. One of these programs is the Intoxicated Driving Resource Center (IDRC). If you are convicted of an alcohol or drug related traffic offense in New Jersey or in another state, like Pennsylvania, and you have a New Jersey driver’s license, you must satisfy the requirements of New Jersey’s IDP Program which include IDRC.
For a first offense DUI/DWI in New Jersey, you can receive between 12-48 hours at the IDRC. If you receive the 12 hour sentence you will attend educational workshops and receive “at risk” screenings for at least 6 hours a day on 2 consecutive days. If you receive a 48 hour sentence at the IDRC, you will attend educational workshops, and receive at risk screenings during a 48 hour consecutive. For second or third DUI/DWIs in New Jersey you can receive jail and/or an inpatient addiction treatment program or both. Following this sentence you will still have to complete 12 hours at the IDRC. Regardless of your sentence at the IDRC you must pay for the program and satisfy all of the requirements of it. If you fail to pay or satisfy the other conditions, it will affect your ability to have your driver’s license reinstated and extend your suspension.
If you are an out of state driver (i.e. Pennsylvania) and you live within 50 miles of any IDRC in New Jersey (i.e. Philadelphia) you will have to schedule and appear at the closest center. If you aren’t within a 50 mile radius you may need to satisfy these requirements in your home state. Finally, if you don’t satisfy the requirements of your sentence, New Jersey will send you a warning giving you 10 business days to respond. If you don’t act within 10 days you could receive a notice of non-compliance and would have 30 days to resolve your outstanding conviction requirements. If you don’t satisfy the requirements and/or correct your non-compliance issues your driver’s license could be suspended indefinitely.
